Terms of Use — VDE 1ª Fase App

Hello, and welcome to the VDE 1ª Fase app.

This application (the “App”) is provided by Vício De uma Estudante Curso Preparatório para Concursos Ltda. (Brazilian company registration — CNPJ 32.584.678/0001-55), part of the Vício De uma Estudante group (“VDE”), and lets you access, on your phone or tablet, the preparatory courses for the 1st Phase of the Brazilian Bar Exam (Exame de Ordem / OAB).

By downloading, installing, or using the App, you agree to these App Terms of Use. Please read them carefully before using the App.

Note: This App and its services are provided in Brazil and governed by Brazilian law.

This is an English translation. The Brazilian Portuguese version prevails in case of conflict.

1. What the App is and who may use it

1.1 The VDE 1ª Fase App is a mobile access tool for the content of the preparatory courses for the 1st Phase of the Brazilian Bar Exam, allowing you to watch video lessons, answer practice questions, follow your study schedule, and use the study materials available for your enrolled course.

1.2 To use the App, you must:

  • Be 18 (eighteen) years of age or older and fully legally capable under civil law;
  • Hold an active enrollment in a VDE course, purchased either within the App or through the official web channels (metodovde.com.br or viciodeumaestudante.com.br).

1.3 The App is part of the VDE Platform ecosystem. Use of the course is also governed by the VDE Platform Terms of Use and the Privacy Notice, available at metodovde.com.br. In the event of a conflict regarding course rules (access period, refund policy for purchases made on the web), the VDE Platform Terms of Use prevail. The rules for purchases made within the App follow Section 4.

2. App license

2.1 VDE grants you a personal, limited, non-exclusive, non-transferable, and revocable license to install and use the App on devices you own, solely for the purposes set out in these Terms.

2.2 This license does not transfer ownership of the App or any part of it to you. The App is licensed, not sold.

2.3 You may not: (i) copy, modify, decompile, reverse-engineer, or create derivative works of the App; (ii) circumvent security, authentication, or content-protection mechanisms; (iii) distribute, sublicense, or make the App available to third parties; (iv) use the App for any unlawful or unauthorized purpose.

3. Registration, account, and account deletion

3.1 Using the App requires creating an account, for which only name and email are required. The other information requested during onboarding (study profile, photo, address, and others) is optional, can be skipped, and the App works normally without it — as detailed in the App Privacy Notice.

3.2 You access the App with email and password. If you already have a VDE Platform account, use the same credentials. You are responsible for keeping your credentials confidential and for all activity on your account. If you suspect unauthorized access, contact support immediately.

3.3 Account deletion: You may delete your account at any time directly in the App, in the settings/profile area. Deleting your account removes your associated personal data, except for information VDE must retain by legal obligation (for example, tax data from purchases) and access logs required by the Brazilian Internet Civil Framework (Marco Civil da Internet), as described in the App Privacy Notice. Deleting your account does not, in itself, entitle you to a refund of courses already purchased, which is governed by Section 4.

3.4 Access to content through the App requires an active enrollment and follows the access period of the purchased course. Once the course access period ends, the content will no longer be available in the App.

4. Purchasing courses: in the app and on the web

4.1 In-app purchase (iOS): In the iOS app, purchasing courses and unlocking access are processed through Apple’s In-App Purchase system, as required by the App Store rules. In this case:

  • Payment is made through your App Store account, subject to Apple’s terms, payment methods, and conditions;
  • Purchase management (history, payment methods, and any subscriptions) is handled through your App Store account;
  • Refund requests for purchases made via In-App Purchase must be made directly to Apple, through its channels (reportaproblem.apple.com), and follow Apple’s refund policy — not VDE’s refund policy applicable to purchases made on the web.

4.2 Web purchase: Courses may also be purchased through VDE’s official web channels (metodovde.com.br and viciodeumaestudante.com.br), with payment processed by Hotmart. Purchases made on the web follow the VDE Platform Terms of Use, including regarding the withdrawal period, refunds, and payment methods.

4.3 Prices: Prices may differ between in-app and web purchases, including due to the conditions and fees applicable to each payment method. The applicable price is always the one displayed at the time of purchase, in the respective channel.

4.4 Regardless of the purchase channel, content is accessed through the VDE Platform and the App, and course use follows the VDE Platform Terms of Use.

5. Device permissions

The App may request the following permissions, always with your authorization and manageable in your device settings:

5.1 Camera: used solely if you choose to take a photo for your profile. Access occurs only when you trigger this feature.

5.2 Photo library: used solely if you choose to select an existing photo for your profile. The App does not access your photos for any other purpose and does not collect images without your direct action.

5.3 Notifications (push): to send study reminders, schedule alerts, and announcements. These are optional (opt-in) and can be disabled at any time (Section 6).

5.4 Declining any permission may limit the corresponding feature but does not prevent use of the App’s core study functions.

6. Notifications

6.1 If you allow notifications, you may receive study reminders and alerts about your course, schedule, new content, and VDE announcements.

6.2 You can disable notifications at any time in the App or device settings, without affecting other features.

7. Updates, compatibility, and availability

7.1 VDE may release App updates to fix issues, improve the experience, or add or remove features. Some updates may be necessary for the App to keep working.

7.2 The App is compatible with the operating system versions (iOS and Android) indicated on the app stores. Devices running outdated versions or below the minimum requirements may experience limitations or may not support the App.

7.3 We will make efforts to keep the App available and functional, but we do not guarantee uninterrupted availability. The App depends on an internet connection and third-party services (stores, infrastructure providers) and may be temporarily unavailable due to maintenance or factors beyond our control.

8. Personal, non-transferable use and conduct

8.1 Access to the App is personal and non-transferable. Sharing login credentials, splitting access, and use of the account by anyone other than the account holder are prohibited, as set out in the VDE Platform Terms of Use.

8.2 Simultaneous access is allowed on a maximum of 2 (two) devices linked to the same account holder, subject to the improper-sharing rules set out in the VDE Platform Terms of Use.

8.3 You may not use the App to record, capture, reproduce, redistribute, or make available to third parties the content of the lessons and materials, including through screenshots, screen recording, or third-party artificial intelligence tools for transcription, summarization, or generation of derivative content.

8.4 You agree to use the App ethically and in compliance with applicable law.

9. Intellectual property

9.1 All content made available in the App — including video lessons, texts, questions, materials, graphics, images, trademarks, logos, layouts, source code, and software — belongs to VDE and is protected by intellectual property rights.

9.2 The App license grants you no rights over this content beyond personal access for study during your enrollment period. Reproduction, distribution, modification, or commercial exploitation is prohibited and subjects the infringer to the penalties provided by law, in particular the Brazilian Industrial Property Law (Lei da Propriedade Industrial).

10. App stores

10.1 The App is distributed through the Apple App Store and Google Play. These stores are distribution channels and, for purchases made through their payment systems (such as Apple’s In-App Purchase), are also responsible for processing the payment and the respective refund, as described in Section 4.

10.2 Your use of the App is also subject to the terms and policies of the store through which you obtained it.

10.3 Where applicable, Apple and Google are third-party beneficiaries of these Terms with respect to the distribution of the App, but the educational service relationship is solely between you and VDE.

11. Privacy and data protection

11.1 The processing of your personal data in the App is governed by the VDE 1ª Fase App Privacy Notice, available on the App’s store page and within the App itself.

11.2 The App collects only the data needed to create your account (name and email) and, optionally, additional study-profile data to personalize your experience, plus usage and device data. The App uses third-party services for analytics and communication, as detailed in the Privacy Notice, always in accordance with the Brazilian General Data Protection Law (LGPD — Lei nº 13.709/2018).

12. Limitation of liability

12.1 VDE is liable for damages it causes under applicable law. It is not, however, liable for damages arising from: (i) improper use of the App by the user; (ii) failures of connection, device, operating system, or third-party apps; (iii) acts of God or force majeure; and (iv) acts of third parties beyond its control, including app store unavailability.

12.2 This section does not exclude VDE’s statutory liability for defects in the service actually attributable to it.

13. Penalties

13.1 Violation of these Terms — in particular improper sharing of access, unauthorized capture or redistribution of content, and piracy — authorizes suspension or termination of access, under the penalties section of the VDE Platform Terms of Use, without prejudice to the assessment of losses and damages.

14. Changes to these Terms

14.1 These Terms may be updated to reflect changes in the App, its features, or legal and store requirements. Material changes will be communicated through the App and/or by email, and the current version will always be available on the App’s store page and within the App.

14.2 Continued use of the App after the new version takes effect constitutes acceptance of the updated Terms.

15. Term and termination

15.1 These Terms remain in effect for as long as you use the App.

15.2 You may end this relationship at any time by deleting your account in the App (Section 3.3) or uninstalling the App. VDE may suspend or terminate your access to the App in the event of a violation of these Terms or of the VDE Platform Terms of Use, or when the access period of the purchased course ends.

17. Governing law and venue

17.1 These Terms are governed by Brazilian law, in particular the Consumer Protection Code (Código de Defesa do Consumidor), the Civil Code (Código Civil), and the Internet Civil Framework (Marco Civil da Internet).

17.2 Disputes may be brought before the courts of the district of Fortaleza, State of Ceará, Brazil, where VDE is headquartered, without prejudice to the consumer’s right — this being a consumer relationship — to file suit in the venue of their own domicile, under article 101, I, of the Brazilian Consumer Protection Code.
